The cardinal role that notions of respect and self-respect play in Rawls’s A Theory of Justice has already been abundantly examined in the literature. However, it has hardly been noticed that these notions are also central for Michael Walzer’s Spheres of Justice. Respect and self-respect are not only central topics of his chapter on “recognition”, but constitute a central aim of his whole theory of justice. In 1979 Harvard biologists Stephen Jay Gould and Richard C. Lewontin published an essay entitled “The Spandrels of San Marco and the Panglossian Paradigm: A Critique of the Adaptationist Programme.” The target of their critique is a style of thinking rooted in “the near omnipotence of natural selection in forging organic design and fashioning the best among possible worlds.” According to Gould and Lewontin, adaptationists assume that all traits of an organism are products of natural selection, and that the traits (...) were favored by natural selection because they were optimal solutions to problems posed by the environment. Gould and Lewontin called the adaptationist program the Panglossian paradigm because they saw strong parallels between the arguments of Dr. Pangloss in Voltaire’s Candide and the arguments of adaptationists and optimality theorists in biology. The concept of community is increasingly the focus of political argument in Britain, the United States and elsewhere around the world. The sense people have of belonging to coummunities provides a powerful motivation which continues to affecct the political and social face of the world. Recently, debate about the relationship between individuals and their communities has become central to the making of both, American and European social policy. In the United Kingdom this is especially apparent in the area of health (...) care, where ideas of community have informed recent legislation concerning community care, community health trusts and the Children Act among others. Auf der Grundlage der jeweiligen Symptomentwicklung der Demenzerkrankung und eigener Erfahrungen im Umgang mit Demenzbetroffenen wirdde rEntwicklungdes Willens in den verschiedenen Stadien der Demenz nachgegangen. Dabei wird den Dimensionen der Differenziertheit der Denkinhalte, der Beurteilungsbasis und der Entscheidungskonstanz eine besondere (...) Bedeutung zugemessen und für eine Graduierung der Selbstbestimmungsmöglichkeiten im Umgang mit Demenzbetroffenen plädiert. Die Arzneimittelzulassung und der Aufnahmeprozess zur Kostenerstattung sollen die Entwicklung und Vermarktung von pharmazeutischen Innovationen mit Patientennutzen nicht behindern, zugleich aber die Wirtschaftlichkeit der Arzneimittelversorgung für die Kostenträger nicht gefährden. Eine Anpassung der Verfahren an die Merkmale personalisierter Arzneimittel erscheint notwendig. Dabei ist allerdings zu fragen, ob eine ungerechtfertigte Privilegierung erfolgt. In den USA und in der EU werden die jeweiligen Zulassungsverfahren für Arzneimittel und Tests schrittweise angepasst und integriert. Zulassung und Erstattungsentscheidungen sollen koordiniert werden. Eine Privilegierung, wie bei Arzneimitteln (...) für seltene Indikationen (Orphan Drugs), findet jedoch für personalisierte Medizin nicht statt. Es bestehen keine unzumutbaren Hürden für die Hersteller. Zurückhaltung bei der Entwicklung innovativer Produkte wäre deshalb nicht gerechtfertigt. (shrink)

This paper examines the concept of ‘openness with patients’ from the stand-point of the limitations of biomedical ethics. Initially we review contemporary critiques of bioethics and, in particular, of principlism; we relate how other; somewhat neglected, forms of medical ethics can yield useful information and provide moral guidance.The main section of the paper then shows how a bioethical approach to openness misses the social context in our example, the viewpoints of patients; we present some of the increasing wealth of research (...) evidence which points towards patients wanting more information and a greater degree of openness.Finally we put forward that a principlist’s objection to active encouragement of openness might be based on the risk of infringing upon the ‘right not to know’. The similarity of documents in a large database of published Fractals articles was examined for redundancy. Three different text matching techniques were used on publisheds to identify redundancy candidates, and predictions were verified by reading full text versions of the redundancy candidate articles. A small fraction of the total articles in the database was judged to be redundant. This was viewed as a lower limit, because it excluded cases where the concepts remained the same, but the text was altered substantially.Far (...) more pervasive than redundant publications were publications that did not violate the letter of redundancy but rather violated the spirit of redundancy. There appeared to be widespread publication maximization strategies. Studies that resulted in one comprehensive paper decades ago now result in multiple papers that focus on one major problem, but are differentiated by parameter ranges, or other stratifying variables. This ‘paper inflation’ is due in large part to the increasing use of metrics (publications, patents, citations, etc) to evaluate research performance, and the researchers’ motivation to maximize the metrics. While most social scientists maintain that the social sciences should stand free of politics, this book argues that they should be politically partisan. Root offers a clear description and provocative criticism of many of the methods and ideals that guide research and teaching in the social sciences.

Studies in the social and biomedical sciences of racial differences in socioeconomic status or health within a population view the race of members as fixed and look for a difference in the frequency of a trait like average income or disease risk between racial subgroups. But, as I explain in this paper, there are good reasons to allow the race of members to vary with the trait whose variation within the population is to be described or explained. According to such (...) a view of race, racial categories are more scientifically significant if membership in the categories is allowed to vary with differences in scientific interest rather than held constant across a variety of interests. Few such simple words have had such a crucial impact on the history of Christian theology. In the summer of 386, Augustine of Hippo was a torn man. He had come to believe the Gospel, but he could not bring himself to break with sinful habits, habits so ingrained he (...) called them "necessities." His soul was torn between two wills within him, he said, each pointing in a different direction. Nothing seemed able to be able to break the interior logjam. He says that he willed that he would will the good, but not with a complete will, and so he remained paralyzed. After hearing a friend and mentor describe the conversion of Victorinus, a famous Roman teacher of rhetoric, and another friend speak of the monastic retreat of St. Anthony, the spiritual conflict within Augustine reached a fever pitch and he retreated to a corner of the garden in the house he was staying at. Suddenly, from over the wall, he heard a child chanting the words tolle, lege: "take up, read." He could not think of any childhood rhyme or chant that involved those words—they must be a sign from God. So, he rushed over to where a copy of St. Paul's letters was lying, opened it, and read at random. This paper argues that realism issue in the social sciences is not one that can be decided by general philosophical arguments that evaluate entire domains at once. The realism issue is instead many different empirical issues. To defend these claims, I sort issues that are often run together, explicate and criticize several standard realist and antirealist arguments about the social sciences, and use the example of the productive/nonproductive distinction to illustrate the approach to realism questions that I favor.

Nelson Goodman claims to have given us a criterion for likeness of meaning that is more stringent than simple coextensiveness and yet that avoids the familiar extentionalist objections. The notion of a nominal compound plays a key role in his account. I show that Goodman's comments concerning this notion are inadequate, that his comments concerning expressions like unicorn-picture are subject to two serious objections: they don't support his claims about likeness of meaning and they make English an unlearnable language.

I compare the tasks that Noam Chomsky and W. V. Quine assign the grammarian and point out that in many cases where Chomsky sees a question of fact Quine sees only a question of convenience. I argue that these differences are attributable, at least in part, to a difference in view concerning the data. Chomsky relies mostly on a speaker's reports of his linguistic intuitions. Quine finds this source methodologically moot. I develop a series of arguments that draw on Quine's (...) theory of radical translation to defend Quine's doubts. (shrink)

Since 1984, he has published a two volume history of the doctrine of justification, a study of Luther's theofogy of the cross, a general introduction to the thought of the Reformation, a study of the late medieval background of (...) the Reformation, a history of German Protestant Christology from the Enlightenment through the present, and popular books on the cross, the Trinity, and Christology. All the while he has lectured in Christian doctrine and ethics at Oxford. What is McGrath saying in this amazing flow of publications? Here I wiH look at three representative works. Iustitia Dei, which traces the understanding of the doctrine of justification from the Bible to Gerhard Ebeling, must be considered the centerpiece of his work to date.1 Luther's Theology of the Cross can be taken as typical of his more monographic work.2 Fina;lly, The Mys.tery of the Cross can exemplify his popular writings.3 I. lustitia Dei has an obvious claim on our attention. The Reformers stated that the docrtrine of justification was the root of their movement. McGrath has chosen an ecumenically decisive topic to survey. Although the length of McGrath's history (378 pages of text) may not justify its separation into two volumes, the division of the volumes follows a clear structural division of the work, a division McGrath finds in the history of the doctrine. After a definition of the subject and a six page discussion.of the pre~Augustinian tradition, the first volume rapidly comes to Augustine, the " fountainhead '' of the Western discussion of justification. The tradition from Augustine to the Reformation is sufficiently unitary that it can be discussed topically under such headings as " the righteousness of God," " the concept of merit,'' and " the relation between predestination and justification." In fact, the topics are so arranged that something of a chronological progression is produced, with the problems that dominated the late medieval period coming last. While the first volume deals with continuity, the second is structured by the major discontinuities of the Reformation and the Enlightenment. A major contention of McGrath is that the Reformation constitutes a break with a relatively continuous tradition. Another, even more radical break comes with the Enlightenment. Thus, the second volume is arranged chronologically and discusses developments from the Reformation through recent hermeneutically oriented interpretations of the doctrine. This outline of the structme of McGrath's hisrtory should make clear its most important characteristic. lt is a history of the discussion of justification in the West on the terms set by Augustine. After a six page leap from the New Testament to the late fourth century, the East is quickly dismissed, never to appear again. Even within the West, the history is selective. The six eenturies between Augustine and Anselm are passed over with only brief mention of the Semi-Pdagian disputes ON ALISTER MC GRATH 707 following Augustine's death and the controversies surrounding Gottschalk rGodescalc] of Orbais. Well over half the book deals with the period between 1050 and 1600 in the West. Following the Reformation, attention is given only to selected figures from the German and English Enlightenment, to Kant and Schleiermacher as critics of the Enlightenment (though Schleiermacher's own doctrine of justification, which in important ways recaptures that of the Reformation, is ignored), to Newman, and to the most prominent German Protestant theologians of recent times (Ritschl, Barth, Bultmann, Tillich, Ebeling). In the United States, the racial and ethnic statistics published by the National Center for Health Statistics (NCHS) assume that each member of the U.S. population has a race and ethnicity and that if a member is black or white with respect to his risk of one disease, he is the same race with respect to his risk of another. Such an assumption is mistaken. Race and ethnicity are taken by the NCHS to be an intrinsic property of members of (...) a population, when they should be taken to depend on interest. The actual or underlying race or ethnicity of members of a population depends on the risk whose variation within the population we wish to describe or explain. (shrink)

Race is a prominent category in medicine. Epidemiologists describe how rates of morbidity and mortality vary with race, and doctors consider the race of their patients when deciding whether to test them for sickle cell anemia or what drug to use to treat their hypertension. At the same time, critics of racial classification say that race is not real but only an illusion or that race is scientifically meaningless. In this paper, I explain how race is used in medicine as (...) a proxy for genes that encode drug metabolizing enzymes and how a proper understanding of race calls into doubt the practice of treating race as a marker of any medically relevant genetic trait. ABSTRACTEthical scandals involving journalists in English-speaking West African countries have been documented to include conflict of interest, freebies, intellectual theft, deception, carelessness, kowtowing to advertisers and politicians, use of dubious evidence, and outright bias. This study explores how pronounced and clear the rules relating to these breaches are in the codes of these countries and whether the similarities and dissimilarities in wording indicate the influence of individual actors involved in writing them. Relying on thematic and qualitative document analysis methods, the (...) study found that rules in the codes addressing the ethical breaches are pronounced and clear. Although largely similar in content, the codes also feature important differences that are strongly related to the composition of the groups that wrote them. This study discusses why ethical challenges in these countries persist in the midst well-written code of ethics. (shrink)

Real kinds or categories, according to conventional wisdom, enter into lawlike generalizations, while nominal kinds do not. Thus, gold but not jewelry is a real kind. However, by such a criterion, few if any kinds or systems of classification employed in the social science are real, for the social sciences offer, at best, only restricted generalizations. Thus, according to conventional wisdom, race and class are on a par with telephone area codes and postal zones; all are nominal rather than real. (...) I propose an account of real kinds that recognizes the current reality of race but not zip codes and shows how a kind can be both constructed and real. One virtue of such an understanding of realism is the light shed on our current practice of racial classification. Race is not a real biological kind but neither is race a myth or illusion. However, the question of whether a social kind is real is separate from whether the category is legitimate. W. E. B. Du Bois maintained that while there are no biological races, race is real and should be conserved. My aim, in this paper, is not to argue for the legitimacy or conservation of race but to defend Du Bois's idea that kinds of people can be both made up and real and provide an understanding of realism that does justice to the social sciences. HUME’S ANSWER TO THE FIRST QUESTION IS ’YES’ AND HIS ANSWER TO (...) THE SECOND IS ’NO’. HUME THINKS THAT A ’NO’ TO THE SECOND QUESTION SHOWS THAT BELIEF IN THE CHRISTIAN RELIGION IS LESS REASONABLE THAN A BELIEF IN MODERN SCIENCE. HOWEVER, HUME’S ’NO’ SEEMS TO OPPOSE HIS EMPIRICISM AND HIS BELIEF THAT THERE ARE NO NECESSARY TRUTHS ABOUT ANY MATTER OF FACT OR EXPERIENCE. THE POINT OF THIS PAPER IS TO SHOW THAT HUME CAN PROVE THAT THERE CAN BE NO TESTIMONY OF SUCH A QUANTITY OR QUALITY TO MAKE IT REASONABLE TO BELIEVE THAT NATURE IS NOT UNIFORM AND, AS RESULT, NO TESTIMONY TO MAKE IT REASONABLE TO. The biomedical sciences employ race as a descriptive and analytic category. They use race to describe differences in rates of morbidity and mortality and to explain variations in drug sensitivity and metabolism. But there are problems with the use of race in medicine. This article identifies a number of the problems and assesses some solutions. The first three sections consider how race is defined and whether the racial data used in biomedical research are reliable and valid. The next three sections (...) explain why racial variation in disease, including genetic disease, is not evidence that race is biological.
